台灣轉型正義
隨著歷史轉型的過程，同時也促使著民主的轉型，台灣政體朝向民主憲政體制的目標發展。因此轉型正義的政治工程， 2016 年 也在國家政治發展的進程中 正式 提上議程。
台灣轉型正義由民間團體的帶動下，政府實質性特別立法，確立了轉型正義的法律位階。同時，民間也有諸多的論 述、期刊、輿論出現，而其中 對於「黨產處理」這一區塊，社會各階層 皆 有不同的爭議與意見，當然也遭致不同的批判及廣泛的討論。
台灣民主轉型下的轉型正義，經由威權轉型成為真正的民主政治，以及形成國家民主化發展，是一種必然循序漸進的過程，當然其中具備各種不同的政治因素和壓力促使轉變。這種「民主的轉型」也同時帶動所謂轉型的正義。
目前執政的民主進步黨在這一個政治工程中，已經決斷而快速的訂定了實體立法條例與 法規，並付諸政策的執行，對於台灣政治權力的運作及台灣未來政黨政治的發展， 具 有重要的影響因素。其中「黨產條例」所引申的憲政問題，充斥著對憲法權威的解釋與挑戰。「轉型正義」中的「黨產條例」是否質變成為政黨的權力鬥爭？造成社會的撕裂，或是對群眾對立，當然也牽動台灣未來民主政治發展的格局，是值得去討論與觀察。
本論文亦以六個國家轉型正義的作為，比較出台灣轉型正義推動作為中，可能存在的問題，並以詮釋我國轉型正義的含意。再以德國為師，依各項因素比較黨產的處理，分析台灣實證作為上的差別，試圖從我國轉型正義與黨產處理特有的精神中，省思並提出台灣在推動「轉型正義」實證作為中，所詮釋的精神內涵。

Along with the process of historical transformation, Taiwan's transitional justice also promotes the transformation of democracy, and Taiwan's political system develops towards the goal of a democratic constitutional system. Therefore, the political project of transformational justice was officially put on the agenda in the process of national political development in 2016.
Driven by civil society, Taiwan's transitional justice has been substantively enacted by the government to establish the legal status of transitional justice. At the same time, there are also many papers,periodicals, and public opinions among the people.
Among them, regarding the "handling of party property", various strata of society have different controversies and opinions. Of course, they have also been subject to different criticisms and extensive discussions.
Transformational justice under Taiwan's democratic transformation, the transition from authoritarianism to true democratic politics, and the formation of national democratic development are an inevitable and gradual process. Of course, there are various political factors and pressures that promote the transformation. This "democratic transformation" also promotes the so-called transformational justice.
In this political project, the Democratic Progressive Party, which is currently in power, has decisively and quickly formulated substantive legislative regulations and regulations, and implemented them into policies. This is of great importance to the operation of Taiwan's political power and the development of Taiwan's future party politics. Influencing factors.
Among them, the constitutional issues raised by the "Party Property Regulations" are full of interpretations and challenges to the authority of the Constitution. Will the "party property regulations" in "transformational justice" essentially turn into a power struggle between political parties? If it causes social division or antagonism among the masses, it will certainly affect the future development of Taiwan's democratic politics, which is worthy of discussion and observation.
This paper also uses the actions of transitional justice in six countries to compare possible problems in promoting transitional justice in Taiwan, and to interpret the meaning of transitional justice in our country. Then, using Germany as a teacher, we compare the handling of party assets based on various factors, analyze the differences in Taiwan's empirical actions, and try to reflect on and propose Taiwan's empirical actions in promoting "transformational justice" from the unique spirit of Taiwan's transitional justice and party property handling. , the spiritual connotation interpreted.
