世界各地家庭僱傭工的工作條件各不相同,但台灣與歐盟的家務工在系譜學上究竟有何異同?為了進行比較分析,我們採訪了十六名在台灣和歐盟工作或曾經工作過的家庭傭工。台灣家務工簽訂了不道德的協議,他們的工資低於最低工資(他們被排除在勞動法之外)、工作時間太長,也沒有足夠的休息日。然而,這些條件仍然好於歐盟的無證家務工。歐洲的無證家務工面臨來自雇傭家庭的虐待、超負荷的工作和不道德的踰矩行為。與台灣家務工相比,歐盟的有證家務工則享有更好的工作環境、符合描述的工作內容,和足夠的空閒時間。台灣和歐盟政府的解決方案是相同的:實施 2011 年國際勞工組織家庭工人公約以確保更好的權利、引導移民家庭僱傭工人進入社會,並提供更好的工作環境。
Abstract
Working conditions of migrant domestic workers differ all around the world, but what are the precise genealogical similarities and differences between those of Taiwan and the EU? Sixteen domestic workers, who work or had worked in Taiwan and the EU, were interviewed in order to conduct this comparative analysis. In Taiwan, workers sign unethical agreements, earn salaries lower than minimum wage (they are excluded from Labour Law), have working hours that are too long, and do not have proper days off. However, these working conditions are still better than those of undocumented workers in the EU, who face abuse, work overload, and unethical behaviour from families. Documented workers in the EU experience a better working environment, with fitting job descriptions and enough free time, compared to Taiwan. The solutions for Taiwan and the EU governments are the same: implement ILO Domestic Workers Convention, 2011 to secure better rights, include migrant domestic workers into the society, and provide a suitable working environment.
